This Privacy Policy applies solely to information collected from you through the FreeCallNow.com website (the "Website") and via the services (the "Services") offered by FreeCallNow.com (“FreeCallNow,” “we,” or “us”).  This Privacy Policy is incorporated into and subject to the terms of the FreeCallNow Terms and Conditions.  By creating a user account or using the Services, you agree to be bound by the terms and conditions of this policy.  This Privacy Policy does not apply to websites, products, or services that are not owned or operated by FreeCallNow, or to information we may receive from other sources, whether or not it is made available through the Services. 

This Privacy Policy May Change From Time To Time

We may revise this Privacy Policy periodically.  If we do revise it, we will place a date at the top of the Privacy Policy to indicate the date it was last revised.  Any changes we make are effective immediately when we post them on this Website.  Because this Privacy Policy may be revised, we encourage you to review it each time you access the Website or use the Services.  When you create an account or use the Services, you are agreeing to the Privacy Policy that is posted at that time.  If you do not agree to all the terms and conditions in this Privacy Policy, you should not create an account or use the Website (if you have already created an account, you should immediately cease using the Services).

Information We May Collect About You

Information that you provide us which identifies you by full name, full postal address, telephone number or email address is referred to as “Personal Information."  You may provide Personal Information to us in various circumstances, including registering for a user account, through user panels and surveys, and in communications to us.  We will use the Personal Information for the purposes for which it was collected and to provide you with the Services you have requested.  

Information such as browser type, operating system, searches, Web pages visited, locality and other information that is not Personal Information is referred to as "General Information."  We may collect General Information in the following circumstances:

• Server log information.  We may automatically collect certain information when you interact with our Website or use our Services.  For example, when you visit the Website, our systems may automatically log your IP address, the type and version of the browser you are using, the date and time of your browsing sessions, and which pages on our Website you visited.

• Advertisers.  We may host (or contract with third parties to host) advertising through the Services.  Some advertisements may include surveys or forms to enter search criteria or other information (e.g. gender, age, location).  The information provided in these advertisements is collected by the advertiser and will be subject to the advertiser’s information and privacy policies.  If you enter information into a form through an advertisement, or visit a website depicted in an advertisement, any information you provide while on such site may be provided to the advertiser.  The advertiser's privacy policies and practices may differ from ours, so you should check the advertiser's privacy policy before supplying information to the advertiser.  Third-party advertisers may also use cookies, Web beacons and similar technologies in connection with the Services.

How We May Use and Share Information

We use the information we collect through the Services for the purpose for which it was provided.  We may use General Information to provide you with a better user experience, develop new Services, deliver targeted advertising, improve the quality of our existing Services, and for internal business purposes.

We are not in the business of selling or disclosing your Personal Information.  However, we may disclose your Personal Information for the following reasons:

Information about you, including Personal Information, may be disclosed as part of any merger, acquisition, debt financing or sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which Personal Information could be transferred to third parties as one of our business assets.

Opting Out of Marketing Communications

Regardless of how you have registered with us or set up your account, you can elect not to receive any marketing messages from us. You may either follow the opt-out instructions provided in the email, sms or other message we send to you, or log in to your account and de-select the box indicating that you would like to receive those communications (if such feature is available). We honor opt-out requests within 10 business days. Please be advised that if you choose not to receive marketing communications, you will continue to receive standard business communications regarding your transactions and account with us (e.g., registration and confirmation emails, and information about your account, if applicable).

Security of your Personally Identifiable Information

We use reasonable security measures to protect your Personal Information from unauthorized use and disclosure while in our control.  However, we can't guarantee that it will never be compromised or disclosed in a way that is inconsistent with this Privacy Policy.  

Children's Privacy

The Services are not intended for and may not be used by children under the age of 13.  FreeCallNow does not target the Services to, or knowingly request, collect, use or share information from, children under the age of 13. Arbitration

Freecallnow and you agree to arbitrate all disputes and claims between us. This agreement to arbitrate is intended to be broadly interpreted. It includes, but is not limited to:

a. claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory;

b. claims that arose before this or any prior Agreement (including, but not limited to, claims relating to advertising);

c. claims that are currently the subject of purported class action litigation in which you are not a member of a certified class; and

d. claims that may arise after the termination of this Agreement.

References to "Freecallnow," "you," and "us" include our respective subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of Services. You agree that, by entering into this Agreement, you and Freecallnow are each waiving the right to a trial by jury or to participate in a class action. This Agreement evidences a transaction in interstate commerce, and thus the Federal Arbitration Act governs the interpretation and enforcement of this provision. This arbitration provision shall survive termination of this Agreement.

A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Dispute ("Notice"). The Notice to Freecallnow should be addressed to: Dispute Resolution, Freecallnow, 93 S. Jackson Street, Suite 19565Seattle, WA 98104 ("Notice Address"). The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought ("Demand"). If Freecallnow and you do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or Freecallnow may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by Freecallnow or you shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which you or Freecallnow is entitled.
